Terms and Conditions for v2-fitness.com (CTPT Online Ltd)

1. Introduction:

These Website Terms and Terms and conditions govern your use of our website, V2-fitness.com, (the “Website”) and your relationship with CTPT Online Ltd (“we”, “us” or “CTPT Online Ltd”). Please read these terms carefully as they affect your rights and liabilities under the law.

2. Services:

2.1 The Services include personalized fitness training programs, nutritional guidance, and online coaching sessions delivered through various communication channels, such as video calls, emails, and messaging platforms.

2.2 The Client acknowledges that the success of the coaching program depends on their commitment, adherence to the provided guidelines, and honest communication with the Coach.

3. Client Responsibilities:

3.1 The Client agrees to provide accurate and truthful information about their health, medical history, and any other relevant details that may impact the coaching process.

3.2 The Client is responsible for notifying the Coach of any changes in their health status, medications, or other factors that may affect the coaching program.

3.3 We are not medical practitioners or registered dieticians. We strongly recommend that prior to commencing any diet or exercise regime that you consult a medical practitioner and/or registered dietitian first.

3.4 We have no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise or diet on a medical condition.

3.5 You acknowledge that when participating in any exercise program that there is the possibility of physical injury

3.6 The Client commits to following the prescribed fitness and nutritional plans and understands that results may vary based on individual effort and dedication.

4. Payments and Refunds:

4.1 The Client agrees to pay the agreed-upon fees for the Services as outlined in the payment agreement (via Stripe).

4.2 Pre-made programme packages are non-refundable after 14 days, except in cases where the Coach fails to deliver the agreed-upon services.

4.3 In the event of programme termination by the Client (after the 14 days) and before the completion of the coaching period, no refunds will be issued.

4.4 The monthly subscription can be cancelled at any time. Simply let us know via email that you wish to cancel before the next payment is due. Once cancelled, you will not be charged again and will be able to continue the service until the end of your current payment period.

5. Confidentiality:

5.1 Both the Coach and the Client agree to keep all information shared during the coaching relationship confidential.

5.2 The Coach may use de-identified and aggregated information for statistical purposes, provided that individual identities are protected.

5.3 The use of any client images by CTPT Online Ltd for marketing purposes is strictly prohibited unless permission is granted by the client.

6. Termination:

6.1 Either party may terminate this Agreement with written notice if the other party breaches any material term of this Agreement.

6.2 The Coach reserves the right to terminate the coaching relationship if the Client engages in behaviour that is deemed inappropriate, disrespectful, or harmful to the coach or fellow group members.

7. Disclaimer:

7.1 The Services provided by the Coach are not a substitute for professional medical advice, diagnosis, or treatment.

7.2 The Client should consult with a healthcare provider before starting any fitness or nutrition program, especially if they have pre-existing health conditions.

8. Limitation of Liability:

8.1 The Coach shall not be liable to you in respect of any losses arising out of events beyond our reasonable control.

8.2 To the maximum extent permitted by law, CTPT Online Ltd accepts no liability for any of the following: 

any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;

loss or corruption of any data, database or software;

any special, indirect or consequential loss or damage.

8.3 We strongly recommend that you seek professional medical advice before embarking on any diet or exercise program.

8.4 Any exercise program, even in healthy individuals, carries risk. You have a responsibility to exercise you own personal judgment, as well as any other considerations, before acting on any of the content provided by us.

8.5 Where we provide you with a Personal Plan, the information contained therein should not be regarded as or relied upon as being a comprehensive health or exercise programme. Accordingly any actions that you take in relation to a personal plan should not be pursued regardless or to the exclusion of other information, opinions or judgments that are available to you.

8.6 Any Personal Plan will have been prepared on the basis of information provided by you. You are responsible for the accuracy of any information that you provide to us. You are responsible for informing us of any health issues or medical conditions when asking us to prepare a Personal Plan.

8.7 Before taking any action in relation to a Personal Plan, you must take into account any other factors apart from the Personal Plan of which you are or ought to be aware.

8.8 The information set out in any Personal Plan may relate to certain contexts and may not be suitable in other contexts. It is your responsibility to ensure that you do not use the information we provide in the wrong context.

8.9 You are responsible for informing us of any health issues and pre-existing medical conditions when you ask us to prepare a Personal Plan.

9. Amendments:

9.1 The Coach reserves the right to modify these terms and conditions at any time. The Client will be notified of any changes, and continued use of the Services constitutes acceptance of the updated terms.

9.2 We reserve the right to make subscription increases and will provide one month's notice of any planned increase.

10. Privacy Policy and Cookie Policy:

10.1 Use of the Website is also governed by our Privacy Policy and Cookies Policy, which are incorporated into these terms and conditions by this reference. To view the Privacy Policy and Cookies Policy, please see below this section.

11. General:

11.1 You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

11.2 These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.

11.7 This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.

By agreeing to these terms and conditions, both the Coach and the Client enter into a legally binding contract for the provision of online fitness coaching services.
